In December of 2001, the Georgia Superior Court recognized what everyone already knows…that a car is never the same after an accident even after it has been repaired. Now that the court system has recognized diminished value, the technical term for the loss in value to your vehicle following an accident, insurance companies must assess for and reimburse anyone who has been in an accident for this loss in value.

The problem is that since January 1, 2002, ClaimCoach has found, in the thousands of assessments that they have processed, that 70-80% of the assessments being done by insurers are understating the actual diminished value suffered by as much as 90%.

Many of these underpayments are due to the interpretation of the formula being used by insurers to determine the diminished value of the car. Insurance companies have chosen to use an older formula distributed by Georgia's Department of Insurance called the commissioner's formula or "17c" when computing settlements. While this formula was a court approved method, the misapplication of the formula calculates a much lower than actual diminished value allowing insurers to make minimal payments.
